SHC asks for comprehensive report on Tharparkar tragedy

KARACHI: A division bench of Sindh High Court (SHC) on Tuesday ordered the District Judge Tharparkar as well as the Judicial Officers under him and other District Judges in the neighbouring districts to inquire into the effectiveness of the relief work being conducted by the Sindh government and the federal government and should submit a detailed report  including, the number of people affected by the ongoing Tharparkar tragedy, the number deaths, the supply and requirement of food and health facilities.
The SHC bench comprising Chief Justice Maqbool Baqar and Justice Farooq Ali Channa issued these orders on an application and a Constitution Petition, filed by some social activists under article 199 of the Constitution read with, sections 151 and 94, c.p.c, 1908.
In the prayer the petitioners have sought court’s order to declare the provincial as well as the federal governments fail to perform their constitutional duty under Article 9, read with, Article 38(d), Constitution, 1973, by failing to prevent deaths caused due to starvations and severe malnutrition.
It has prayed the Court to direct the federal government as well as the Sindh government to pay reasonable and appropriate compensation for every death caused by starvation and severe malnutrition during the ongoing Tharparkar calamity, as well as to all persons who have suffered severe health problems caused by starvation and severe malnutrition during the ongoing Tharparkar tragedy.
They have sought the SHC intervention to direct the Sindh government and federation to take administrative and departmental action against government officials, as well as government departments and private individuals, found liable for the ongoing Tharparkar tragedy.
They have demanded the government to place the names of all persons, prima facie suspected of being guilty of criminal negligence resulting in the ongoing Tharparker tragedy on the exit control list and honourable Court may also to restrain such suspected persons from disposing off their moveable or immoveable properties.
The Sindh government as well as the federal government be asked to create a permanent monitoring setup/unit in district Tharparkar in order to prevent future deaths due to starvation and severe malnutrition. The government be directed to publish a detailed programme of measures to be taken by them to prevent any future deaths due to starvation and severe malnutrition in the province of Sindh.
The Court was requested to direct the Sindh administration and the federation to establish a Commission composed of well reputed members of civil society to periodically monitor the Sindh government’s constitutional obligation to implement the right to food of the citizens and persons living in Sindh.
