KARACHI: Sindh High Court (SHC) on Saturday restrained railway authorities from creating third party interest on the land admeasuring 117 square yards near Wazir Mansion Railway Station, owned by Pakistan Railways (PR) till further orders.
A division bench headed by Justice Muneeb Akhtar gave this interim injunction on the petition filed by Naziruddin Niazi, proprietor of Islam Weighbridge, who moved the Court against railway authorities for leasing out railways land unlawfully.
Malik Khushhal Khan counsel for petitioner said railway authorities were dispossessing the petitioner of piece of land admeasuring 117 square yards near Wazir Mansion Railway Station despite the fact he was legal leaseholder of the land.
He claimed railway officials were allotting plots on 99-year lease in the vicinity of Wazir Mansion Railway Station to some blue-eyed persons in violation of the relevant laws. For this purpose, he said the petitioner was being forced to leave the land.
Citing secretary Railways Ministry, general manager land and management and divisional superintendent PR as respondents, the petitioner requested the Court to restrain officials of PR from dispossessing him of his land.
After initial hearing, the bench issued notice to respondents and federal law officer to file comments on petition by August 12.
Meanwhile, the Court restrained railway authorities from creating third party interest on the land allotted to petitioner.
