LAHORE: Justice Ayesha A Malik of the Lahore High Court (LHC) dismissed a petition against Punjab University Law College’s selection board for the post of associate professor for promoting faculty member Dr Shazia Qureshi to the rank of associate professor by holding that no discrimination or any irregularity had been committed by the PU administration in this case.
Assistant Professors Samee Ozair, Nawaz Dogar, Iftikhar Ahmed Tarrar and Shahbaz Ahmed Cheema had filed a petition against the selection board, submitting that Dr Shazia was being promoted to the rank of associate professor arbitrarily upon which the LHC had granted a stay order against the selection board from finalising the promotion process.
Shahzad Shaukat, counsel for the university, submitted that Iftikhar Tarrar and Nawaz Dogar had submitted application for a post of associate professor advertised in 2007 but they could not meet the eligibility criteria as their research papers had not published in journals approved by the Higher Education Commission. He said that both assistant professors were informed about their ineligibility and that they had already challenged their ineligibility through a petition before the LHC but that they had not informed the court about their previous petition.
He submitted that Shahbaz Cheema did not apply for the post of associate professor advertised either in 2007 or in 2011, so he could not challenge the proceedings of the selection board formed for an associate professor vacancy re-advertised in 2013 as none of the applicants were not eligible for the same vacancy advertised in 2011.
He said that Samee Ozair was ineligible for the post of associate professor advertised in 2007 and 2011 while a call letter had been sent to him to appear before the selection board for the vacancy advertised in 2013.
The judge dismissed the petition by observing that documents relied upon did not establish discrimination whereas the petitions of Iftikhar Tarrar and Nawaz Dogar were dismissed because they tried to hide facts from the court and tried to get relief.
Because of the stay order, the selection board had not finalised the promotion of Dr Shazia as associate professor. After dismissal of the petition, the selection board will meet on Saturday (today) to finalise her promotion.
