SC to invoke Article 190 if road not vacated

ISLAMABAD: The Supreme Court of Pakistan on Wednesday observed that it may invoke Article 190 of the constitution if its order related to the vacation of the Constitution Avenue is not implemented and obeyed by the protestors of the Pakistan Awami Tehreek (PAT).Resuming the hearing of petitions seeking a restraining order against any extra-constitutional act by any authority, filed by the Supreme Court Bar Association (SCBA) and other identical petitions of other bar councils, a larger four-member bench of the top court headed by Chief Justice of Pakistan Justice Nasirul Mulk heard the case. The court noted that the Article 190 of the constitution states: “All executive and judicial authorities are bound to act in aid of the Supreme Court.” The constitution says these authorities “shall act” in aid of the top court, thus leaving no other option but to get the apex court’s orders implemented. The mention of Article 190 by the top court leaves no room for disobedience of any orders of the court by any authority and such disobedience is termed unconstitutional, the court noted. Justice Mulk observed, “If the court orders are not be implemented the court will invoke Article 190 of the constitution for the implementation of its orders.”
