ISLAMABAD: The Supreme Court on Monday dismissed the review petition of PML-Q leader Moonis Elahi in the National Insurance Company Limited (NICL) case.
A three-member bench headed by Justice Jawwad S Khawaja, and whose other members are Justice Gulzar Ahmed and Justice Mushir Alam, heard the NICL review petition and dismissed it. According to reports, the petitioner wanted to change his lawyer but the court rejected this request. Earlier, the court had dismissed all the review petitions filed in NICL scam case by Major (r) Habibullah Warriach, Mohsin Habib Warriach, National Accountability Bureau (NAB) Chairman Major (r) Qamar Zaman Chaudhary, Federal Tax Ombudsman Abdul Rauf Chaudhry, FIA Director Waqar Haider and Agro Tractor.
The court had remarked that it had not declared anyone accused in the NICL judgement, as this could only be determined after a transparent inquiry. However, prima facie, the investment process in the NICL was non-transparent, it noted. The judgement in the NICL case had stated that the transfer of Investigation Officer (IO) Zafar Qureshi affected the inquiry process of the case.
The court had observed that it only stated that the fraud was committed in the purchase of land and, therefore, NAB was directed to recover the money and not to declare anyone as accused. The court had also remarked that NAB inquiry would determine what the volume of corruption was and who were responsible for it. “It is NAB’s responsibility to inquire the matter and recover the money,” the court ruled.
