‘Zardari bail cancellation order could be recalled’

KARACHI: Syed Pir Ali Shah, the district and session judge central, who cancelled the bail of Asif Ali Zardari on Tuesday, is competent to hear and decide cases if he is not conveyed the order of his transfer, said Farooq H Naek, advocate.

Asked if Syed Pir Ali Shah could hear cases, including that against Zardari, after his transfer was ordered, Naek said he could hear and pass order on cases till he was conveyed the order of his transfer.

“We have no way to know whether he has been conveyed the order of his transfer when he heard the Justice Nizam murder case and pass the order of cancellation of Zardari’s bail,” said Naek. Another senior lawyer, Nisar A Mujahid, said a judge could hear and pass order unless he was asked to relinquish his charge to the person transferred in his place. He said an appeal could be filed in the Sindh High Court for recalling the bail cancellation order of Zardari. staff report
