LHC orders inquiry against magistrates

LAHORE: Justice Syed Shabbar Raza Rizvi of the Lahore High Court (LHC) on Saturday ordered an inquiry into the conduct of three judicial magistrates who allegedly did not entertain a petition seeking the exhumation of a deceased woman.

Petitioner Samiul Haq told the court that his wife died on September 30. He said that somebody, whom he did not want to name, told him that a man, Yousaf, and his accomplice had poisoned his wife. He said that he moved an application in the court of the Shahdra judicial magistrate on November 17, but the magistrate did not issue orders for the exhumation, saying that he didn’t have the jurisdiction.

Mr Haq said that he was directed to file an application in the court of the Lower Mall judicial magistrate who also failed to pass the required order and directed him to approach Model Town judicial magistrate Ghulam Dastgeer.

The petitioner said that eventually he filed an application with the Lahore sessions judge’s court who forwarded the case to an additional district and sessions judge. The additional sessions judge again forwarded the case to Mr Dastgeer.

The petitioner asked the LHC to redress his grievances for the medical examination of his wife’s body. Justice Rizvi directed the Lahore sessions judge to conduct an inquiry into the magistrates’ conduct and issue appropriate orders to redress the petitioner’s grievances. staff report
