Missing person’s family moves PHC
PESHAWAR: Family member of a missing person on Tuesday moved the Peshawar High Court (PHC) seeking his whereabouts and release. Maseen, a resident of Daggar in Buner district and brother of the missing person named Dilawar, filed a writ petition through Mohammad Sabir and Raees Khan advocates in the provincial high court, seeking whereabouts and release of his missing brother. In the writ petition, he stated that his brother along with his family members was living in a Karachi’s IDP camp. On June 14, 2009, he claimed, his brother was picked up by Takht Bhai Police in Mardan district from Jandai Tableeghi Markaz in suspicion of being a Taliban while he was returning to his home in Buner. He further stated that SHO Takht Bhai Police Station Mumtaz after the arrest took him to the police station where JUI-F former MNA Shujaul Mulk and Takht Bhai Nazim Ziaullah also met with him (his brother). He said that the SHO concerned then handed him over to intelligence agencies and since then, his whereabouts were not know to his family. The petitioner made NWFP chief secretary, District Police Officer (DPO) and SHO Takhat Bhai as respondents in the writ petition. Meanwhile, a PHC division bench comprising Chief Justice Ejaz Afzal Khan and Justice Liaqat Ali Shah issued notice to Landi Kotal assistant political agent (APA) for detaining two citizens of a settled area under section 40 of Frontier Crimes Regulation (FCR). Adnan and Sheraz, residents of Gulbahar, had filed a writ petition against their detention under 40 FCR. The petitioners’ lawyer stated that under the law, political administration had no right to detain citizens of a settled area. On this, the court issued notice to the APA to explain his position in next hearing of the case. staff report
