Retirement notification issued for two PHC PCO judges

PESHAWAR: The Law and Justice Division has issued retirement notifications to two Peshawar High Court (PHC) judges who had taken oath under the Provisional Constitution Order (PCO) and had applied for premature retirement, PHC sources told Daily Times on Wednesday.
Sources said PHC judges Hamid Farooq Durrani and Said Maroof Khan had been issued retirement notifications after their applications, which they filed after being issued contempt notices by the Supreme Court, were approved by President Asif Ali Zardari.
They said the PHC had received the retirement notifications “some two days ago”.
Justices Durrani and Maroof had applied for early retirement to the PHC registrar on October 26.
The superior court adjudicators, who had taken oath under the PCO, came under the spotlight after the SC’s verdict declared that PCO judges had violated the verdict that was passed on November 3, 2007 by a seven-member bench of the apex court, restraining judges from taking or administering oath under any extra-constitutional act.
However, they were not removed from their posts immediately as the judgment stated that they would be removed by the Supreme Judicial Council under Article 209 of the constitution after references were filed against them by the federal government.
