CM rejected recommendations for appointments to PWD, SHC told
KARACHI: Sindh Chief Minister Qaim Ali Shah rejected the recommendations made by the Sindh Public Service Commission (SPSC) in respect of appointments to the Population Welfare Department (PWD) as interviews for the posts were held in violation of rules and norms, said the comments filed by a section officer in para wise comments/written reply by the department.
The comments were filed on Thursday before a division bench of the Sindh High Court comprising Acting Chief Justice Mushir Alam and Justice Aqeel Ahmed Abbasi and seized with the hearing of Dr Marvi Memon and 13 other petitioners who were recommended for employment in BPS 17 by the SPSC after completion of all formalities.
The section officer (Appeals) Abdul Rahman Panja stated that the Sindh government and PWD have complied with the orders of the court by disposing off an identical petition filed by the petitioners on the same grounds. He stated that as per orders of the court Sindh government either has to accept the recommendations of SPSC, issue offer and appointment letters or in case of rejection has to pass a speaking order.
The comments said that the Sindh chief minister exercising powers conferred on him under Sub Rule (3) of Rule 7 of SPSC 1990 has held that interviews for the subject posts on contract basis were in clear violation of rules and not acceptable.
The CM also ordered the department to re-advertise the posts. The section officer with the above comments prayed to the court to dismiss the petition. The bench after hearing the sides reserved its order.
Construction on amenity plot: The Sindh High Court Thursday appointed its nazir as commissioner to inspect the construction work initiated in violation of a court order by the Khidmat-e-Khalq Foundation on an amenity plot in Old Clifton area.
The plaintiff, Shabbir Hussain Bhaijeewala, along with other residents of Old Clifton, filed applications seeking action against the in-charge of the Khidmat-e-Khalq Foundation for violating the court order. They cited the KKF in-charge, the CDGK, the housing and town planning provincial secretary, EDO (master plan), CDGK Environmental Protection Department, DO (land management) and DO (revenue) as defendants.
Barrister Muhammad Omer Soomro submitted that the City Council, through a resolution on February 2, 2009, illegally leased 666.66 square yards amenity plot between 59 and 61 Old Clifton to the KKF in-charge for 99 years to establish an ambulance depot.
Following the plaintiffs’ lawsuit, the SHC on February 26, 2009 directed the defendants not to change the status of the amenity plot, which was being used as nursery for 30 to 40 years. But, the defendant, the KKF in-charge, recently initiated the demolition and construction work on the plot in violation of the SHC order. The counsel contended this was tantamount to contempt of court and prayed to take action against the defendants.
